Terms of Service
These Terms of Service ("Terms") govern your use of the SecureVista Tech website and the security installation, maintenance, and support services we provide. By engaging our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing our website, submitting a booking request, or signing a service proposal, you ("Customer") agree to these Terms of Service. If you do not agree, do not use our website or services.
For commercial engagements, these Terms incorporate any signed service agreement or statement of work. In the event of a conflict, the signed agreement controls.
2. Services
SecureVista Tech provides electronic security services including:
- Security camera system design, installation, and configuration
- Video intercom and access control system installation
- Maintenance plans, service calls, and repair work
- Consulting and system design services
All services are performed by SecureVista Tech employees licensed under Texas DPS Private Security Bureau License #B-12088. We do not subcontract installation work.
3. Quotes & Proposals
Quotes and proposals issued by SecureVista Tech are valid for 30 days from the date of issue unless otherwise stated. Quotes are based on conditions observed during the site walk and information provided by the Customer.
If conditions materially differ from what was documented at the site walk β such as undisclosed existing infrastructure, additional scope requested by the Customer, or concealed structural obstacles β we reserve the right to revise the quote before work begins.
Free assessments: Initial site walks and written proposals are provided at no cost and create no obligation on either party.
4. Payment Terms
Unless otherwise agreed in writing:
- Residential projects β 50% deposit required to schedule installation; remaining 50% due upon completion
- Commercial projects under $10,000 β 40% deposit, 60% net 15 days after completion
- Commercial projects over $10,000 β milestone-based payments as specified in the signed agreement
- Maintenance plans β billed monthly via auto-pay; cancel any time
We accept major credit cards, ACH transfers, checks, and wire transfers (for amounts over $5,000).
Late payments are subject to a 1.5% monthly service charge (18% annual) or the maximum rate permitted by Texas law, whichever is lower. Customers with unpaid balances over 30 days may have warranty coverage suspended until the balance is resolved.
5. Scheduling & Access
Scheduled appointments are confirmed by email and text. Customers may reschedule without penalty with at least 24 hours' notice.
If our technician arrives at the scheduled time and cannot access the property or begin work due to Customer-related delays, a trip charge of $95 may apply.
For commercial projects, the Customer is responsible for obtaining any required building access approvals, permits, or landlord consents before installation day. SecureVista Tech will assist with documentation as needed but does not assume responsibility for third-party approvals.
6. Installation
Installation timelines quoted are estimates based on typical project conditions. Actual timelines may vary due to weather, permitting delays, concealed obstacles, or Customer-requested changes.
Any change to scope after installation begins β including additional cameras, relocation of equipment, or changes to the original design β will be quoted separately and requires Customer approval before proceeding.
Concealed conditions: SecureVista Tech is not responsible for damage to concealed wiring, plumbing, gas lines, or structural elements not disclosed by the Customer before installation. Customers must disclose known locations of such elements during the site walk.
7. Warranty
All installations are covered by our 2-year workmanship warranty (3 years for enterprise projects). Equipment carries the manufacturer's own warranty, which we manage on your behalf during the covered period.
Full warranty details, coverage exclusions, and claims process are described on our Warranty page, which is incorporated into these Terms by reference.
8. Customer Responsibilities
To ensure safe and effective service, the Customer agrees to:
- Provide accurate information about the property, existing infrastructure, and intended use
- Ensure safe access to installation areas, including attic, roof, and crawl spaces
- Disclose known locations of concealed utilities, wiring, and structural elements
- Obtain any necessary HOA or landlord approvals before installation
- Maintain the installed system as recommended (firmware updates, physical cleaning)
- Notify SecureVista Tech promptly of any system issues or suspected tampering
- Not permit unauthorized third parties to modify, disassemble, or service the system
9. Intellectual Property
All content on our website β including text, images, logos, and code β is the property of SecureVista Tech LLC or its licensors and is protected by copyright and trademark law.
System designs, wiring diagrams, and configuration documentation we provide are licensed to the Customer for their own use of the installed system. They may not be shared with third-party contractors or used to replicate our work without written consent.
Camera footage captured by installed systems is the property of the Customer (property owner). SecureVista Tech claims no ownership of customer footage.
10. Limitation of Liability
To the maximum extent permitted by Texas law, SecureVista Tech's total liability arising out of or relating to any project shall not exceed the total amount paid by the Customer for the specific services giving rise to the claim.
In no event shall SecureVista Tech be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Lost profits, lost business opportunities, or loss of data
- Damages arising from Customer misuse, modification, or unauthorized service of the system
- Failures of third-party networks, ISPs, or cloud storage providers
- Losses that could have been prevented by proper system maintenance
- Acts of God, natural disasters, or events outside our reasonable control
Important: A security system reduces risk but does not eliminate it. SecureVista Tech does not guarantee that any system will prevent theft, intrusion, or other losses.
11. Indemnification
The Customer agrees to indemnify, defend, and hold harmless SecureVista Tech, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Customer's breach of these Terms
- Customer's failure to disclose known property conditions or hazards
- Unauthorized use of installed equipment by Customer or third parties
- Claims by third parties regarding surveillance footage or privacy
12. Termination
Either party may terminate a service agreement with written notice in accordance with the following terms:
- Residential projects β Customer may cancel before installation for a full refund of the deposit, less any equipment already ordered (non-refundable)
- Commercial projects β cancellation terms are specified in the signed agreement
- Maintenance plans β cancel any time with no penalty; billing stops at the end of the current month
SecureVista Tech reserves the right to terminate service for non-payment, abuse of our staff, or violation of these Terms.
13. Dispute Resolution
Any dispute arising from these Terms or our services shall be resolved as follows:
- Informal resolution β The parties agree to first attempt to resolve the dispute through direct communication within 30 days
- Mediation β If informal resolution fails, disputes shall be submitted to non-binding mediation in Travis County, Texas
- Binding arbitration or litigation β If mediation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, or by litigation in the state or federal courts of Travis County, Texas
The prevailing party in any dispute is entitled to recover reasonable attorneys' fees and costs.
Class action waiver: To the extent permitted by law, the Customer agrees that disputes will be resolved individually and not as part of any class or representative action.
14. General Provisions
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with any signed service agreement or proposal, constitute the entire agreement between the parties and supersede any prior understanding.
Assignment
Customer may not assign these Terms without our written consent. SecureVista Tech may assign these Terms in connection with a merger, acquisition, or sale of substantially all assets.
Force Majeure
Neither party shall be liable for delays or failures caused by events outside their reasonable control, including natural disasters, severe weather, public health emergencies, or government action.
